Retired justice urges repeal of Second Amendment

- A call from a retired U.S. Supreme Court justice to repeal the Second Amendment has President Donald Trump saying "no way" as he hopes to make a solidly conservative court the lasting legacy of his time in office. "We need more Republicans in 2018 and must ALWAYS hold the Supreme Court!"

He also embraced legislation that would ban semiautomatic weapons, increase the minimum age for buying a gun from 18 to 21 years old, and establish a "more comprehensive" background check system on all purchases of firearms.

But Stevens wasn't done.

In 2008, the Supreme Court overturned Chief Justice Burger's and others' long-settled understanding of the Second Amendment's limited reach by ruling, in District of Columbia v. Heller, that there was an individual right to bear arms.

"I'm not sure that Justice Stevens realizes that any campaign to repeal the Second Amendment will only strengthen the Republican Party and President Trump", he said.

Stevens' call for repeal of the Second Amendment will do little more than further polarize the pro-gun and anti-gun factions with no real promise of opening the door to meaningful firearms legislation.

Mr. Stevens filled his dissenting opinion with a strained reading of the text and history of the Second Amendment to assert that its sole objective was the preservation of state militias to protect against the excesses of a standing army or a foreign invasion.
